This document is an electronic record in terms of Information Technology Act, 2000 (as amended from time to time) and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.Fresh bag which acts as an intermediary e-commerce marketplace facilitating delivery of Fruits & Vegetables, Grocery and product of daily usage. The marketplace is a platform for domestic consumers to transact with third party sellers, who have been granted access to the Site. The firm does not provide any services to users other than providing the marketplace as a platform to transact at their own cost and risk, and other services as may be specifically be notified in writing.

By accessing and/or using the Site the user acknowledges that he/she has read, understood and agrees to be legally bound by the terms and conditions set forth in this document. If you do not agree to abide by this User Agreement (the “Agreement”), you are not permitted to access or use the Site. All text, graphics, design, content, and other works are copyrighted works of firm. The firm acknowledges proprietary rights of third parties displayed on the Site.

For purpose of this Agreement the terms “we”, “us” or “our”, refer to FreshBag or firm user interchangeably. ACCEPTANCE OF TERMS

1. Account & Registration Obligations
All shoppers have to register and login for placing orders on the Site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. By agreeing to the terms and conditions, the shopper agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in "My Account" or by contacting the customer service

2. Pricing
All the products listed on the Site will be sold at MRP unless otherwise specified. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities and fresh food prices do change on a daily basis. In case the prices are higher or lower on the date of delivery not additional charges will be collected or refunded as the case may be at the time of the delivery of the order.

3. Cancellation by Site / Customer
You as a customer can cancel your order anytime up to the cut-off time of the slot for e placed an order by calling our customer care. In such a case we will refund any payments already made by you for the order. If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.

4. Return & Refunds
Customer will make payment after checking the quality and quantity of product.
Customer can return the product if they are not satisfied with quality of product.

5. TRADEMARKS
The names of actual companies, websites, services and products mentioned herein and on the Website, may be the trademarks of their respective owners. FreshBag acknowledges the proprietary rights of the trademarks of other parties mentioned both in this document and on the Website. Any rights not expressly granted herein are reserved.

6. YOUR CONSENT
By using the Website, you consent to the terms of our Agreement and to the Site’s processing of information for the purposes given above.

7. PAYMENT SECURITY
FreshBag is only supporting payment at your door step by ‘Cash on delivery’ and by ‘Online wallets’. Kindly check the product at the time of delivery and make payment, contact the merchant and settle the final amount to be paid.

8. TERMINATION
Either fresh bag or user may terminate this Agreement at any time. Without limiting the foregoing, fresh bag shall have the right to immediately terminate user’s account in the event of any conduct by user which freshbag in its sole discretion, considers to be unacceptable, or in the event of any breach by user of this Agreement.

9. MEMBER ACCOUNT, PASSWORD, AND SECURITY
If any of our services require user to open an account, user must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. User also will choose a password and a user name. User is entirely responsible for maintaining the confidentiality of user’s password and account. Furthermore, user is entirely responsible for any and all activities that occur under user’s account. User agrees to notify the firm immediately of any unauthorized use of user’s account or any other breach of security. The firm will not be liable for any loss that user may incur as a result of someone else using user’s password or account, either with or without user’s knowledge. However, user could be held liable for losses incurred by the firm or another party due to someone else using user’s account or password. User may not use anyone else’s account at any time, without the permission of the account holder.

10. USER CONDUCT

• User shall use the Website for lawful purposes only. 11. You Agree and Confirm

• That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by fresh bag for redelivery shall be claimed from you.
• That you will use the services provided by the Site, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Site.
• That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
